CAMPUS REVIEW BODY

1.                  PURPOSE

The Campus Review Body (CRB) is a centralized, institutional body for hearing appeals by students who have been sanctioned because of misconduct or academic failure.

2.                  DEFINITIONS

a.                   Academic Sanction – Sanction imposed on a student by a School/Program based on student’s failure to meet the academic standards or requirements of his/her School/ Program.  Such sanctions may include (1) academic dismissal; (2) academic suspension; or (3) the requirement that a student repeat a given course or year.  Receipt of a failing grade in a given course shall not constitute an academic sanction for purposes of this policy.

b.                  Conduct Sanction – Sanction imposed on a student by a School/Program for unprofessional or unbecoming conduct including but not limited to violation(s) of the Student Conduct Code, Student Housing Agreement and/or local, state or federal law or by the Office of Student Affairs for violations of the Student Housing Agreement.

c.                   Final decision – For purposes of this policy “Final decision” refers to the written decision of the Dean of a School.  Only a final decision may be heard by the CRB.
 

3.                  JURISDICTION

The CRB shall have jurisdiction over all Schools and students comprising the Medical College of Georgia to review:
 

a.                   Academic Sanctions that represent the final decision of any School with respect to a student. Cases involving academic sanctions will be heard by a review body composed solely of faculty members of the CRB.  (CRB shall not have the authority to review decisions as to a student’s grade in an individual course). 

b.                  Conduct Sanctions that represent the final decision of any School or the Office of Student Affairs with respect to a student.

4.                  COMPOSITION

The CRB shall consist of eleven (11) members and shall include:

a.                  Five (5) students, one from each School, as recommended by the President of the Student Government Association and appointed by the President of the Medical College of Georgia and who shall serve one (1) year terms and be eligible for reappointment; and

b.                  Five (5) faculty members, one from each School, at least two (2) of whom are tenured faculty and who shall be appointed by the President of the Medical College of Georgia.  In addition, the Chair of the Academic Council Grievance Committee shall serve as Chair of the Campus Review Body.  Faculty members shall serve three (3) year terms and are eligible for reappointment.

5.                  PROCEDURE 

a.                  Student receives the final written decision of his/her School as to an Academic or Conduct Sanction.  This written statement from the Dean will advise student of the right to request a hearing before the CRB within five (5) working days of receipt of the School’s final decision.   

b.                  Within five (5) working days of receipt of the School’s final decision, the student must make a written request for a hearing before CRB to the Vice President for Enrollment and Student Services or his designee.  The Vice President for Enrollment and Student Services or his designee will notify the CRB Chairperson of the hearing request. 

 c.                 Within five (5) working days of receipt of a request for hearing, CRB will conduct an evaluation of the request and notify the student in writing that CRB will:

1)                  Deny the request for hearing based on a determination that the student was given adequate due process (including a hearing) in accordance with written School policies and procedures and Board of Regents requirements; or

2)                  Grant the request for a hearing based on:

a)                  a determination that the student did not receive a hearing at the School level and is entitled to one under  the law and/or the Board of Regents requirements; or

b)                  a determination that additional facts/information concerning the matter have come to light; or

c)                  for other valid cause.

d.                  If the CRB denies the request for hearing pursuant to 5.3 above, then the written notice to the student (with a copy to the Vice President for Enrollment and Student Services) will include notification of the right to appeal to the President of the Medical College of Georgia within five (5) working days of the student’s receipt of the notice from CRB.

e.                   If the CRB grants the request for a hearing, then the CRB shall send the student written -notice setting forth a date and time for the hearing. For the hearing, the CRB shall appoint a review body, composed of no less than three (3) members of the CRB to conduct the hearing.  In no event shall the number of students appointed to such a review body exceed the number of faculty appointed.  Additionally, in cases involving academic sanctions the review body shall be composed solely of faculty member of the CRB.  CRB shall have ten (10) working days from the date of its decision to grant the hearing to conduct the hearing and submit its final recommendation to the Provost

f.                    The CRB will recommend to the Provost that the School’s final decision be affirmed or reversed, in whole or in part. 

g.                   Within two (2) working days of receipt of the CRB’s recommendation, the Provost will review the recommendation and notify the student and School in writing of his decision.  This written decision will include notification to the Student of the right to appeal to the President of the Medical College of Georgia within three (3) days. 

h.                   The time periods set forth in this policy may be waived by mutual consent and with the approval of the Provost.
