
1. If an employee receives a subpoena, request for production of documents, or any other request for a medical record, a copy of the request should be immediately forwarded to the record requests division of the department of Health Information Management.
2. In the event that an employee receives a witness subpoena, a subpoena for a deposition, or any other request from an attorney in a matter involving MCG or the employee's treatment of a particular patient, a copy of the document should be immediately forwarded to Legal Affairs for review. The Legal Affairs Office will assist the employee in providing a proper response to the request. Legal Affairs should be promptly notified upon receipt of any such subpoena or request, at extension 1-4018. Do not ignore a subpoena. The failure to comply with a subpoena may cause an individual or MCG to be held in contempt of court and subject them to possible penalties of a fine and/or imprisonment.
3. In the event any MCG employee receives, either through the mail or through personal service, a summons, lawsuit, or any other legal document related to his or her employment, the document must be immediately forwarded to Legal Affairs. The failure to comply with this procedure could affect the employee's right to be represented by the attorney general's office or could also affect the employee's insurance coverage. No one at MCG is authorized to accept service on behalf of MCG. Please contact the Legal Affairs Office at 706-721-4018 with any questions in this regard.
