By-laws,
Officers, &c. of the Medical College of Georgia, 1835. Section I. From and after the passing of this act, William R. Waring, John Carter, Lewis D. Ford, Ignatius P. Garvin, Benj. A. White, Samuel Boykin, Wm. P. MConnell, Walter H. Weems, William P. Graham, Thomas P. Gorman, Alexander Jones, Milton Antony, John J. Boswell, Thomas Hoxey, James P.Scriven, William C. Daniel, Richard Banks, Henry Hull, John Dent, Thomas Hamilton, Tomlinson Fort, Nathan Crawford, O. C. Fort, and John Walker, and their successors, shall be, and they are hereby constituted and created a body corporate, by the name and style of the trustees of the Medical Academy of Georgia. Section II. Said trustees be, and they are hereby authorized to have, and use a common seal, and to alter the same at pleasure; and by their corporate name, to sue and be sued, plead and be impleaded, answer and be answered unto, in any court of law or equity; and also ordain, establish, and alter at pleasure, such by-laws, rules and regulations, as may be necessary and convenient for the government of the said corporation, the direction of the affairs, and the management of the property thereof: Provided, such by-laws, rules and regulations, shall not contravene the constitution and laws of this State, or of the United States. Section III. The said trustees shall be, and they are hereby authorized, to establish within the corporate limits of the city of Augusta, a Medical Academy for the State of Georgia, on such principle, and under such rules and regulations, and with such professors, instructors, and officers, as may be best calculated to perpetuate the same, and promote the improvement of its pupils in the several branches of the healing art. Section IV. It shall be the duty of the said trustees to assemble annually at the medical academy in Augusta, and on such day as may be fixed on by the by-laws, for the purpose of examining into the affairs of the institution and generally managing its concerns; and the said trustees, together with the regular professors and teachers in the institution, shall constitute a board of examination, whose thorough examination, to decide on the merits of such candidates as may have studied in the said institution at least one year, and complied with all the conditions imposed by the board of trustees, as preliminary to such examination, and confer the degree of bachelor of medicine on such as may in their judgment be worthy of the same. Section V. The board of trustees, at their annual meeting, shall appoint a committee of three of their number to serve as an executive committee, whose duty it shall be to attend in the recess of the board, semi-monthly, or at the call of the regular teachers enforcing the execution of the rules and regulations, prescribed by the board of trustees; their decisions being liable to the revision of the board of trustees, at their next annual meeting. Section VI. The board of trustees shall cause to be kept a book, in which shall be registered the name, age and place of nativity of each and every person who shall receive from this institution, the degree of bachelor of medicine, and the time when the said degree was conferred, together with the names of the members of the board of examination present, and the book so kept shall be considered a book of record, and a transcript form the same, certified by the proper officer, shall be taken and received as evidence of the conferring of the said degree, in any court of law within this State. Section VII. Not less than five members shall constitute a quorum of the board of trustees; but any less number may adjourn from day to day, until a sufficient number shall attend to form a quorum. Section VIII. The board of trustees of the medical academy be, and the same are hereby empowered to have, hold, use and enjoy, purchase, receive, and dispose of at pleasure, lands, houses and other property, real and personal, to an amount not exceeding one hundred thousand dollars. Section IX. The graduates of the medical academy shall be allowed to practice medicine and surgery in this State, in the same manner as they would have been, had they been examined an licensed by the board of physicians of the State of Georgia, any law, custom or usage to the contrary notwithstanding. Section X. The said trustees shall have authority to fill all vacancies in their body, which may occur by death, resignation or otherwise. Section XI. Any two or more of the trustees above named be, and they are hereby authorized to call a meeting of the board at any time they may think proper, to be holden in the city of Augusta, for the purpose of making and establishing such by-laws as are authorized by this act.
An Act to alter the name of the Medical Academy of Georgia, and to extend the corporate powers of the same. Passed 19th December, 1829. Section I. Be it enacted, &c. That from and after the passage of this act, the Medical Academy of Georgia, shall be entitled and known as "the Medical Institute of the State of Georgia." Section II. The trustees, together with the regular professors and teachers of the medical institute, shall constitute a board, which is hereby authorized and empowered to confer the degree of doctor of such times, and under such circumstances as may to the said board, seem fit and proper: Provided, that the degree of doctor of medicine shall in no case be conferred on any person who shall not have attended two full courses of lectures in the institute, or one course in some other respectable medical college or university, and one in the institute, in addition to the usual term of private instruction required by other institutions of a like kind. Section III. [Repealing clause.] An Act to provide a fund for the outfit of the Medical Institute of the State of Georgia, and to alter the name of the same.
Be it enacted by the Senate and house of Representatives of the State of Georgia, in General Assembly met, and is hereby enacted by authority of the same, That the sum of tem thousand dollars be, and the same is hereby appropriated to and for the benefit and use of the Medical Institute of the State of Georgia, for the e purpose of enabling the board of trustees of said institute to procure a suitable piece or lot of land, erect thereon such buildings and make such other improvements as may be necessary for the various purposes of a medical college, and to procure a suitable library, apparatus and museum for said institution, and such other things as may be necessary to the proper and successful operation of the same. That the sum of tem thousand dollars be, and the same is hereby appropriated to and for the benefit and use of the Medical Institute of the State of Georgia, for the e purpose of enabling the board of trustees of said institute to procure a suitable piece or lot of land, erect thereon such buildings and make such other improvements as may be necessary for the various purposes of a medical college, and to procure a suitable library, apparatus and museum for said institution, and such other things as may be necessary to the proper and successful operation of the same. Section II. And be it enacted by the authority aforesaid, That the said appropriated sum shall and may be drawn for the Central Bank, in semi-annual payments, the first payment to be drawn on the first day of February, 1834, by the treasurer of said medical institution, by producing to the proper officers of said bank, the resolution of the board of trustees to that effect. Section III. And be it enacted by authority aforesaid, That fifty lots on the own common of the city of Augusta, be, and the same are also hereby appropriated to the said medical institution, which said lots are to be designated by the city council of the city of Augusta and the trustee of the Richmond Academy, and sold by them, and the proceeds of said sale to be paid over to the treasurer of said institution, under a resolution of the said board of trustees for the purposes aforesaid: Provided, that the majority of the city council and trustees of said academy shall approve of the same. Section IV. And be it enacted by the authority aforesaid, That said city council and trustees of said academy, if they approve of the third section of this act, shall not proceed to sell said lots until requested so to do, by a resolution of said board of trustees. Section V. And be it enacted by the authority aforesaid, That from and after the passage of this act, the Medical Institute of the State of Georgia, shall be known and designated by the name and style of the Medical College of Georgia. Section VI. And be it enacted by the authority aforesaid, That all laws or parts of laws militating against this act be, and the same are hereby repealed. The By-laws of the Medical College of Georgia, being the Medical Department of the University of Georgia Article I. The board of Trustees shall meet annually on the Second Wednesday in April, at the Medical College, at 4 P. M. Article II. The Board shall always include not less than nine members unconnected with the Medical profession. Article III. Any member absenting himself from the meetings of the Board for two successive years, without rendering a satisfactory excuse, shall be considered as having vacated his seat. Article IV. The officers of the Board shall be a President, Vice-President, Secretary and Treasurer, and an Executive Committee of three, to be elected at each annual meeting. All officers shall hold their offices until their successors are elected. Article V. All elections shall be by ballota majority of the votes given being necessary to a choice. Article VI. The President shall preside over and preserve decorum at all meetings of the Board. He shall confer degrees, in the absence of the Chancellor. Article VII. The Vice-President shall perform the duties of President in his absence. Article VIII. In the absence of both the President and Vice-President, a chairman shall be appointed to preside over the meeting. Article IX. It shall be the duty of the President to sign and cause to be sealed all diplomas granted by the College. Article X. The offices of Secretary and Treasurer shall be held by the same individual; whose duty it shall be to record faithfully in a suitable book all the proceedings of the Board and conduct their correspondence. He shall receive and keep a correct account of all funds accruing to the College from donation, legacies or otherwise, and of all payments made by order of the Board or of the Executive Committee, and render a report thereof at each annual meeting. Article XI. The Executive Committee shall be chosen at each annual meeting of the Board; their duty shall be (in addition to those elsewhere specified) to call a meeting of the Trustees, whenever in their opinion, materially important to the interest of the College, or when requested by two-thirds of the Faculty, to make contracts and direct payments thereon, when instructed by the Board, to keep a correct account of their transactions and report the same to the Board. Article XII. The Faculty of this College shall consist of ten Professors, chosen by the Board of Trustees, one for each of the following branches, viz: Anatomy, Physiology, Chemistry and Pharmacy, Gynecology, Materia Medica and Therapeutics, Institutes and practice of Medicine, Obstetrics and Diseases of Women and Infants, Principles and Practice of Surgery, Opthalmology, Otology and Laryngology, Operative and Clinical Surgery, Histology, Pathology, Bacteriology and Clinical Microscopy. Each professor shall deliver a full course of lectures on their respective branches within each annual term. Article XIII. The course of instruction shall commence annually on the first Monday in October, and terminate within the week preceding the first day of April. Article XIV. The Professors shall hold their offices during good behavior, subject to impeachment and trial as directed in article 19. Article XV. The Faculty shall constitute a standing committee, to examine candidates for the Degree of Doctor of Medicine, and they shall report to the Board those they deem qualified for that Degree. Article XVI. No student shall be an eligible candidate for the Degree of Doctor of Medicine until he shall have attended three full courses of instruction of not less than six months each, in three separate years, in some regular medical college of colleges in good standing, of which courses the last must be taken in this Institution. Article XVII. No candidate shall be reported to the Board for a Degree without the approbation of seven Professors. Article XVIII. The Degrees shall be conferred publicly on such a day immediately following the close of the Session as the Faculty may recommend. Article XIX. Any officer or professor or member of the Board of Trustees may be removed from office by a vote of two-thirds of the Board of Trustees called under the advice of the Executive Committee and the President of the Board, in a special meeting for the purpose, the Secretary having given 15 days notice to the accused of the specifications and charges. Article XX. The following shall be the form of the Diploma of this College: Omnibus et singulis, quorum intersit, salutem: Nos, praeses, Pro-Praeses et Professores Collegii Medici Georgiensis testamur _______ _________Postquam se suosque in Re Medica progressus probasset, a nobis esse honoratum Gradu Medicinar Doctoris; Eique, Muncra ubique Gentium exercendi; singulaque jura, honores, et privilegia, quae Doctori Medicinae, al ibi gentium conceduntur concedimus. In cujus fidem, liters hisce, communi sigillo Collegii nunitis, nomina nostra subscribmus. Datum Augustae, Georgia, Anno Domini. Datum Augustae, Georgia, Anno Domini. This Diploma shall be signed by the President, Chancellor of the University, and Professors, and sealed with the seal of the College and the seal of the University. Article XXI. Power shall be deputed to the Faculty to make all further regulations that may be necessary for the more immediate management and better discipline of the Collegesubject, however, to the revision of this Board. Article XXII. Any of the foregoing by-laws and regulations may be altered or repealed at any meeting; provided ten days notice shall have been duly given each member, of such contemplated action. Article XXIII. When recommendations shall be made by the Faculty to the Board of Trustees, for election to chairs in the College, such recommendations shall be made by not less than a three-fourths vote of the Faculty.
